Terms of Use
Last updated: 26 October 2026
Welcome to Heartpact. These terms are the agreement between you and HeartPact, 651 N Broad Street, Middletown, Delaware 19709, USA ("we", "us"), and they apply whenever you use the Heartpact app, our website or the service behind them. We have tried to keep them short and readable. By creating an account, you agree to them. If you do not agree, please do not use Heartpact.
Our Privacy Policy explains how we handle your data. It is part of how we run Heartpact, so please read it too.
1. Your health and safety come first
Please read this section carefully.
- Exercise at your own risk. Dares ask you to do physical exercise, sometimes when an alarm goes off and you were not expecting it. Only do exercise you are fit and able to do, in a safe space with room to move. Warm up, and never do a dare while driving, at work where it is unsafe, or anywhere you or others could get hurt.
- Stop if it hurts. Stop straight away if you feel pain, dizziness, faintness, shortness of breath or anything that feels wrong, and get medical help if you need it. No dare, streak or score is worth an injury. You can always silence the alarm on your phone.
- Heartpact is not medical advice. Nothing in Heartpact is medical, health or fitness advice, or a substitute for a doctor. Talk to a healthcare professional before starting a new exercise routine, especially if you are pregnant, have recently given birth, or have a heart condition, injury or any other health concern.
- Cycle and pregnancy features are estimates. Period, fertile window and due date predictions are calendar estimates for planning only. They are not medical advice, they are not a diagnosis, and they must not be used as contraception or to try to avoid pregnancy. Always follow the advice of your doctor or midwife.
- Food estimates are approximate. Calorie and nutrient estimates from photos are made by an AI model and can be off by 30 to 40 percent or more. Treat them as a rough guide, not as nutritional or medical guidance. If you have an eating disorder, diabetes, an allergy or any condition affected by diet, please rely on your healthcare professional, not on Heartpact.
- The camera checks are not a coach. Rep counting and form tips are automatic and can be wrong. They are not a judgement of your fitness or technique.
2. Who can use Heartpact
You must be 18 or older to use Heartpact. By creating an account, you confirm that you are at least 18, that you can enter into this agreement, and that you are not barred from using the service under the law that applies to you. Heartpact is a personal service for couples, not for business use.
3. Your account
- Give accurate details when you sign up, including your date of birth, and keep them up to date.
- Keep your password safe and do not share your account. You are responsible for what happens on it. If you think someone else has got in, reset your password straight away, which signs you out everywhere, and tell us.
- One account per person. Do not create an account for someone else or pretend to be someone you are not.
- We may send you messages about your account, such as password reset codes and important changes to the service.
4. Couples, linking and unlinking
Heartpact works best with two people. You link with your partner using an invite code or link, which lasts 48 hours. You can be linked to one partner at a time.
When you link, you and your partner can see each other's shared information as described in the Privacy Policy: dares and their results, the shared album, daily answers, games and their scores, and whatever you choose to share from your food log, cycle, pregnancy and location.
Either of you can unlink at any time, without needing the other's permission. When a couple ends:
- Your partner is told, and you stop seeing each other's information.
- All dares stop, any ringing alarm is cancelled, and open games end.
- The shared album closes. For 30 days, each of you can download or delete the photos and videos you uploaded yourself. After that, the whole album is permanently deleted, including both people's uploads. Please save anything you want to keep.
- Your own food log, cycle and pregnancy data stay in your account. Cycle sharing goes back to "nothing", and both partners' location records are deleted.
- Heartpact Plus stays with whoever paid for it (see section 8).
- Linking again later, even with the same person, starts a fresh space. The old album does not come back.
5. Dares are a game you both choose
Dares are meant to be fun, playful and motivating, for two adults who both want to take part. Either of you can set a dare for either of you, and when it rings, the phone keeps ringing until the camera counts the reps, your partner lets you off, or the time window passes.
You are always in control:
- You can silence the alarm on your own phone at any time.
- You can ask your partner to let you off, and they can grant it.
- You can pause or delete any dare set for you whenever it is not ringing.
- You can switch off notifications or the camera permission in your phone's settings.
- You can unlink at any time, which stops every dare at once.
Never use dares, or anything else in Heartpact, to pressure, punish, humiliate, threaten or control your partner. Respect a "no", and do not set dares that you know your partner does not want or cannot safely do.
The same goes for games, such as a Heart to heart duel, where you both play the same skill rounds and compare scores. They are for fun. Scores are measured by your phone and can be off, and a lost game is never a reason to pressure anyone.
6. Acceptable use
Heartpact is built on trust between two people. When you use it, you agree not to:
- coerce, harass, threaten, stalk, abuse or intimidate anyone, including your partner;
- share intimate images or any photos or videos of another person without their consent;
- upload anything illegal, including any content that sexually exploits or endangers children, which we will report to the authorities;
- upload content that infringes someone else's rights, or that you do not have permission to share;
- sign in to someone else's account, or link someone's phone without their knowledge;
- tamper with the app, the camera checks, game scores or the integrity check, or use a modified version of the app;
- try to get around plan limits, rate limits or security measures, or to access data that is not yours;
- reverse-engineer, scrape, overload or disrupt the service, or use automated tools against it;
- use Heartpact for any unlawful purpose.
If you are worried about your safety in a relationship, please contact local support services or, in an emergency, the emergency services.
7. Location sharing
Location sharing is mutual: you see your partner only while you are both sharing, and each of you can always see whether the other is sharing, paused or off. You can stop or pause at any time. Sharing also stops when you sign out on any of your phones, and when the phone that is sharing has not been heard from for 10 minutes.
- Share location only with someone who knows about it and agrees to it.
- Never use Heartpact to track or stalk anyone. Do not install Heartpact on another person's phone, switch on sharing for them, or keep it on without their knowledge.
- Location can be inaccurate or delayed. Do not rely on it in an emergency.
We will suspend or close any account we believe is being used for stalking or covert tracking, and we may report it to the authorities.
8. Heartpact Plus subscriptions
Heartpact is free to use, with some limits. Heartpact Plus raises those limits (for example, more photo calorie scans per day, more album storage and a longer daily question history). We may change what each plan includes; if we reduce what a paid plan includes, we will tell you in advance.
- Sold through Google Play. Plus is bought and billed through Google Play, and Google's terms apply to the payment. Prices, including any taxes, are shown in Google Play before you buy.
- Auto-renewal. Plus renews automatically at the end of each monthly or yearly period, and Google Play charges you, until you cancel. If you start with a free trial, it turns into a paid subscription when the trial ends unless you cancel before then.
- Failed payments. If a renewal payment fails, Google Play may keep Plus going for a grace period while it tries again. If the payment still fails, the subscription goes on hold and Plus stops until the payment is fixed in Google Play.
- Cancelling. Cancel any time in Google Play (Play Store, then Payments and subscriptions). You keep Plus until the end of the period you have paid for.
- Refunds. Refunds are handled through Google Play under Google's refund policies. In some cases we may also be able to help; contact us at [email protected]. Nothing here affects your legal rights as a consumer.
- One subscription covers both of you. When one partner subscribes, both partners get Plus while you are linked. The subscription belongs to the person who paid. If you unlink, it goes with them, and the other partner returns to the free plan.
- Deleting your account does not cancel your subscription. Google Play keeps charging until you cancel there. Please cancel in Google Play before you delete your account. The app warns you if your subscription is still set to renew.
9. Your content
Your photos, videos, captions, answers, notes, logs and everything else you add to Heartpact ("your content") remain yours.
So that we can run Heartpact, you give us a worldwide, non-exclusive, royalty-free licence to store, copy, process, transmit and display your content only to operate and provide the service to you and your partner. That includes sending a meal photo to our AI provider when you ask for an estimate, and storing album files with our storage provider. We do not use your content for advertising, we do not sell it, and we do not use it to train AI models. The licence ends when your content is deleted, apart from the short time it takes to remove it from our systems and backups.
You are responsible for your content. Please only share content you have the right to share, and only include other people with their permission.
If you send us feedback or ideas, we may use them to improve Heartpact without owing you anything.
10. Our service
- We are always improving Heartpact, so features may change, be added or be removed.
- Alarms and notifications depend on your phone, its settings, battery saving, your connection and services run by others such as Google. They can be late or fail. Do not rely on Heartpact to wake you up, remind you of anything important or keep you safe.
- We do our best to keep Heartpact available and your data safe, but we cannot promise it will always be available or free of errors.
- Heartpact, its name, design and software belong to us or our licensors. These terms give you a personal, non-transferable right to use the app; they do not give you any other rights in it.
11. Ending your use of Heartpact
You can stop using Heartpact at any time and delete your account in the app (Us, then Delete my account) or at heartpact.me/delete-account/. Deletion is immediate and permanent; the Privacy Policy explains exactly what is removed.
We may suspend, disable or close your account if you seriously or repeatedly break these terms, if your use puts someone at risk, or if the law requires it. Where it is appropriate and safe to do so, we will tell you why and give you a chance to respond. We may also stop offering Heartpact altogether; if we do, we will give you reasonable notice so you can download your data.
Sections 1, 9 (feedback), 12, 13 and 14 continue to apply after your account ends.
12. Disclaimers
Heartpact is provided "as is" and "as available". To the extent the law allows, we make no promises beyond those in these terms, including any implied promises about fitness for a particular purpose, accuracy (for example, of rep counts, form checks, game scores, food estimates, cycle predictions or location), or that the service will be uninterrupted or error-free.
Heartpact is a way for two people to connect. We are not responsible for how you and your partner behave towards each other, in the app or outside it.
13. Limitation of liability
To the extent the law allows, we are not liable for any indirect or consequential loss, or for loss of data, profits or opportunity, arising from your use of Heartpact. Our total liability to you for any claim relating to Heartpact is limited to the greater of the amount you paid for Heartpact Plus in the 12 months before the claim, or US$100.
Nothing in these terms limits or excludes liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited or excluded by law. If you are a consumer, nothing in these terms affects your statutory rights.
14. Governing law and disputes
These terms are governed by the laws of the State of Delaware, USA. Any dispute will be handled by the state or federal courts located in Delaware. If you are a consumer living elsewhere, you also keep the protection of the mandatory laws of your country, and you may bring a claim in your local courts.
If something goes wrong, please contact us first at [email protected]. Most problems can be sorted out quickly that way.
15. Changes to these terms
We may update these terms as Heartpact changes or the law requires. If a change is significant, we will tell you in the app or by email before it takes effect. If you keep using Heartpact after that, you accept the new terms. If you do not agree, you can delete your account at any time.
16. General
If any part of these terms turns out to be unenforceable, the rest still applies. If we do not enforce a term straight away, we can still enforce it later. You may not transfer your rights under these terms to anyone else. We may transfer ours as part of a reorganisation or sale of our business, and your rights will not be reduced as a result. These terms, together with the Privacy Policy, are the whole agreement between you and us about Heartpact.
